By accessing, browsing and using our Website you acknowledge that you have read, understood and accepted, without reserve, these Terms and Conditions, as modified from time to time by us.
1.2 If we decide to modify our Terms and Conditions, we will post a new dated version on our Website. Therefore, we invite you to consult these Terms and Conditions from time to time in order to familiarise yourself with any changes.
2.1 The content of our Website and namely but not exclusively the texts, marks, logos, diagrams, photographs, videos, sounds, music, layout, designs, know-how, technologies, products, and processes are the property of Professional Digitizing, or are used with the authorisation of the owners, and accordingly are protected by copyright, trademarks, patents and all other intellectual or industrial property rights which exist under applicable law.
2.2 Nothing contained on our Website shall be interpreted or construed as granting you a license or a right to use any such content of our Websites.
3.1 All the products offered by Professional Digitizing are digital services and they will be delivered in digital files via email. We are not responsible for any delays caused by third-party delivery services. Additionally, please check your spam folder, as delivery emails may be filtered there.
3.2 The embroidery files will be sent to the email address provided by the client with delivery times of:
3.3 If your delivery date falls on a scheduled holiday, the files will be delivered on the next business day. Please note that any changes requested after your order has been processed can delay the original scheduled delivery date.
3.4 We accept three means of payment:
3.5 If you purchase any product or service through our Website, you agree to provide accurate payment information and authorize us to charge your chosen payment method. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. A decline in payment can result in a delay in your original promised file delivery date.
4.1 All files are hand-digitized using the instructions included in your quote and the image you submitted. Please ensure the accuracy of all instructions and images before processing your order. We will use this information to create your file.
5.1 The embroidery files will be sent to the email address provided by the client with delivery times of:
Simple Design from 12 to 36 hours, medium Design from 24 to 48 hours and complex Design from 48 to 96 hours.
5.1 If you request cancellation before the design file is sent, you may be eligible for a full or partial refund.
5.2 Please note that once the design file has been sent, refunds could no longer be available, unless there is a design flaw attributable to Professional Digitizing. In such cases, we will work with you to address and correct the issue.
5.3 Refunds are handled on a case-by-case basis. If you are not satisfied with our service, please contact us within 30 days of your purchase to discuss a possible refund.
6.1 If a design is faulty, the cost of the design will be reimbursed. At least one modification to the design and photograph of the embroidered sample is required.

8.1 These Conditions are written in English. In the event of any conflict, the English version will prevail.
9.1 Client Artwork: By submitting your design file to Professional Digitizing, you acknowledge that you have obtained all proper permissions or licensing for the use of any logo, pattern or design protected by copyrights, patents, trademarks or other intellectual property rights and you hereby agree to hold harmless and indemnity Professional Digitizing and its partners, employees, affiliates and agents against all loss, expenses, damages, costs and legal fees by reason of any actions based on the infringement thereof. You also understand that it is your responsibility to proof the digitized design prior to production and Professional Digitizing is not responsible for any damaged garments.
10.1 While Professional Digitizing acknowledges and understands that all logos, patterns and creative art works submitted for digitization are the copyright of their respective owners, Professional Digitizing reserves the right to use the items listed below as a part of its portfolio, case study, etc. (whether online or offline) for the purposes of showcasing its embroidery digitization capability and quality of work, and advertising for its service.
